War Risk: Request for insurance to War Risk areas must be submitted to marineinsurance@tgal.us for approval and rates.

Areas considered “War Zone” include:

  • Africa – Benin, Eritrea, Gulf of Guinea, Libya, Nigeria, Somalia
  • Asia – Pakistan
  • Europe – Georgia
  • Indonesia/ Malaysia / Philippines

Minimum premium – based on $15,000

Bases of valuation – Can declare just cost of goods or sum of Cargo, Insurance, Freight plus up to additional 10%

Limit of Liability – $1,000,000

Deductible – 1% with minimum deductible of $250

Coverage is Port to Port or warehouse to warehouse (container shipments). Excludes mechanical and/or electrical derangement.

On construction/agricultural equipment excludes claims for wear, tear, scratching, marring as well as rust, oxidation or discoloration.

Claims Surveys – Lloyd’s Undewriters agents &/or Surveyor to be appointed in respect of all claims which are expected to be in excess of $1,000.00

This insurance is subject to the exclusive jurisdiction of the English Courts, except as may be expressly provided herein to the contrary.

Period: Twelve months Open Cover to accept all risks attaching on or after 00.01hours on 15th

August 2012 local time and expiring 00.01hours on 15th August 2012.

Cancellation Clause: Subject to 30 days notice of cancellation from either party at any time for Marine risks, 7 days notice of cancellation for War, Strikes, Riots and Civil Commotions risks, but 48 hours notice of cancellation for Strikes,Riots and Civil Commotions risks in respect of sending to or from the USA.

Cancellation shall become effective on the expiry of the appropriate number of days from midnight of the day on which notice of cancellation is issued by Assured or to Underwriters but shall not apply to any transit insurance which shall have been declared or attached in accordance with contract terms and conditions before the cancellation becomes effective.

Conveyances: Per Land,Sea or Air Conveyances but excluding ocean tows unless agreed by Underwriters prior to shipment.

A) Boats

Subject to a deductible of 1.00% (one per cent) of the insured value with a minimum deductible of USD 250 each and every claim each boat.

From port to port or tackle to tackle only.

B) Household Goods and Personal Effects

Subject to itemized inventory

Warranted professionally packed

Subject to attached LPO 222 Conditions.

C) Chinaware,Glassware,Crystal,Cement,Tiles and Glass Items

Breakage and cracking claims subject to a deductible of 5.00% (five per cent) (minimum of USD 500) of the insured value.

Warranted professionally packed for export.

D) Automobiles

Including unboxed motorcycles

Subject to a deductible of 1.00% (two per cent) of the insured value with a minimum deductible of USD 250 each claim each automobile.

Risk to attach from time of delivery to the Steamship Company at port of shipment and continues until delivery by the Steamship Company at port of destination, but not exceeding 15 days after discharge from the Steamer.

Notwithstanding the above, automobiles shipped in containers are covered hereunder from warehouse to warehouse.

No coverage shall be granted hereunder while the vehicle is under its own power except during loading or unloading to or from a carrying vessel or conveyance or to or from ship’s side within port area.

Excludingclaims for mechanical and/or electrical derangement.

E) Machinery

Institute Replacement Clause CL372 1.12.08 &/or the Second-hand

Replacement Clause as applicable.

Excluding mechanical or electrical derangement. Deductible of 1.00% of insured value

Used or Reconditioned Machinery:

Excluding claims for wear, tear &/or gradual deterioration. Excluding claims for scratching, marring &/or cost or repainting. Excluding claims for rust,oxidation or discoloration.

F) Alcoholic Beverages

Subject to a deductible of 1.00% (one percent) of the insured value (minimum

USD 250) for pilferage and breakage.

G) Frozen Foods

Institute Frozen Food Clauses (A) (excluding Frozen Meat) CL263 1.1.86 &/or Institute Frozen Meat Clauses (A) CL323 1.1.86. Institute Strikes Clauses (Frozen Food) (excluding Frozen Meat) CL265 1.1.86 &/or

Institute Strikes Clauses {Frozen Meat) CL326 1.1.86.

In respect of refrigerated interests the above Clauses amended to

‘temperature controlled’ as appropriate.

H) Steel Sheets,Bars and Pipes

Excluding claims for rust, oxidation,discoloration,twisting and bending. Subject to the following Cutting Clause:

In the event of a claim for damage to pipes and tubes Underwriters shall only be liable for the damaged parts providing that the damage is such that it is practicable to use the remaining sound portion of the pipe or tube for the purpose for which it was originally intended.

The damaged portion of each pipe or tube to be cut off and Underwriters to pay the proportionate value of each part cut of and to receive any salvage of such proportion.

I) Bagged Items

Insuring conditions for bagged commodities are ICC ‘B’ unless goods are packed in paper bags shipped in sealed ‘Door to Door’ containers which shall be subject to ICC ‘A’ but subject to a deductible of 2.00% (two per cent) of insured value each bill of lading separately insured.

J) Perfumery Products & related items of every description

Insuring conditions all risk, port to port coverage only. All claims subject to a

2% (minimum USD 500) deductible ofthe insured value. In no case shall this insurance cover ordinary leakage, ordinary loss in weight or volume or ordinary wear & tear of the subject-matter insured or theft or any unexplained shortage unless such theft or shortage can be demonstrated to have taken place by violent &/or forcible entry to the container &/or carrying conveyance &/or place of store during the period of this insurance.

Shipments within continental United States via common carrier warranted GPS tracking &/or team drivers no coverage for vehicle left unattended. In addition to these insuring conditions the ones for air or ocean transit also apply.

No shipment in excess of USD 100,000 to be insured without underwriters’ approval.

Warranted: All shipments by air are in non-descript packaging and sealed with TOPP Clip seals or similar security devices and shipments by ocean are shipped in door to door containers and are secured with a locking bar or wire seal securing both turning bars.

K) Electronic Equipment & related items of every description

Insuring conditions all risk, warehouse to warehouse coverage only. All claims subject to a 1% (minimum USD 500) deductible of the Insured value except for shipments of white goods and household appliances other than goods such as DVD’s,VCR’s IPOD’s,Plasma &/or LCD,LED or DLP Televisions, digital cameras &/or goods of a similar nature.

In no case shall this insurance cover ordinary leakage, ordinary loss in weight

or volume, or ordinary wear & tear of the subject-matter insured or theft or any unexplained shortage unless such theft or shortage can be demonstrated to have taken place by violent &/or forcible entry to the container &/or carrying conveyance &/or place of store during the period of this insurance. Shipments within continental United States via common carrier warranted GPS tracking &/or team drivers. No coverage for vehicle left unattended.

L) Cargo Placed inside of Container-it, LLC

Warranted must be inspected prior to loading by Accurate Marine Surveyors, Inc. &/or Gold Coast Repairs, Inc. Warranted Inspection seal must be placed on the container and a copy of the inspection report provided to Cargo International. Warranted Inspection of the containers can not be more than

30 days prior to shipping.
